These General Terms and Conditions of Sale govern purchases made through the website www.designtrasparente.com

2. Scope of application

These General Terms and Conditions of Sale apply to purchases made through the website by both consumers and professionals, companies, entities and other parties purchasing in connection with their professional or business activities

A consumer means a natural person acting for purposes unrelated to any business, commercial, craft or professional activity carried out by that person

A professional means a natural or legal person acting in the course of their business, commercial, craft or professional activity, or an intermediary thereof

The provisions of the Italian Consumer Code concerning relationships between professionals and consumers apply exclusively to purchases made by consumers

3. Subject of the sale

Designtrasparente sells products and furnishings made mainly of plexiglass and other materials, available in different configurations, sizes and characteristics

The products may be:

standard products available in the catalogue

standard products manufactured exclusively following the customer's order

products modified in terms of dimensions or characteristics based on the customer's requests

products designed and manufactured specifically according to the specifications provided by the customer

The availability of a product on the website does not necessarily mean that the product is physically in stock

Designtrasparente may manufacture the product after receiving the order, according to the production times indicated on the relevant product page

Manufacturing the product after the order has been placed does not, in itself, make the product personalised and does not automatically exclude the consumer's statutory right of withdrawal

4. Personalised and made-to-order products

Products are considered personalised or made-to-measure, where provided for by applicable law, when they are manufactured according to specific requests from the customer that modify their characteristics compared with the standard configuration offered by Designtrasparente

By way of example, personalised products include:

products manufactured with dimensions different from the standard dimensions indicated on the relevant product page

products for which the customer requests modifications to width, depth, height or other dimensions

products for which shapes, configurations, processing methods or characteristics not included in the standard configuration are requested

products designed or manufactured specifically on the basis of instructions, drawings, measurements or specifications provided by the customer

products not included in the catalogue and manufactured specifically for the customer

Personalisation may also be requested through notes entered by the customer during the purchasing process

In particular, a request to modify the standard dimensions of a product through the order notes results in the product being manufactured according to personalised specifications

When a product not included in the catalogue is manufactured specifically for a customer, Designtrasparente may create a specific product page dedicated to that customer containing the agreed characteristics and conditions

Such a product is also considered, where provided for by law, to have been manufactured according to the customer's specifications

For made-to-measure or clearly personalised products, the consumer's right of withdrawal is excluded in the cases and within the limits provided for by Article 59 of the Italian Consumer Code

Any exclusion of the right of withdrawal does not affect the consumer's statutory rights relating to the legal guarantee of conformity

5. Product characteristics and images

The characteristics, dimensions, materials, colours and other product specifications are indicated on the relevant product page or, in the case of personalised products, in the documentation and specifications agreed with the customer

Images displayed on the website are for illustrative purposes and may include settings, decorative elements or accessories not included in the supply

Lifestyle or demonstration images do not prevail over the technical and descriptive characteristics indicated on the relevant product page

The materials used are subject to the inherent characteristics of their nature and of the artisanal manufacturing processes

Any differences in colour, transparency, reflections, grain, minor surface characteristics or other slight variations compared with images or previous production runs may be due to the characteristics of the material, processing conditions, lighting and screen display and, where they do not affect the functionality or conformity of the product, do not in themselves constitute a defect

6. Manufacturing tolerances and artisanal production

Products manufactured by Designtrasparente are handcrafted and certain manufacturing processes involve natural dimensional tolerances

Heat-bent products

For furniture and furnishings manufactured by manual heat bending, such as, by way of example, trolleys, tables, bedside tables, consoles and similar products, the material is heated and subsequently bent manually

For this reason, the final dimensions may have an indicative tolerance of approximately 1–2 cm compared with the theoretical or requested dimension

This tolerance is a characteristic of the artisanal manufacturing process and must be taken into account when designing and using the product

Thickness of cast plexiglass

The cast plexiglass used to manufacture the products naturally presents variations in thickness resulting from the material's manufacturing process

For display cases, boxes, containers and similar products, the actual material thickness may have an indicative tolerance of approximately 1–2 mm

For furniture and larger products, the thickness tolerance may be greater and may increase in relation to the nominal thickness of the material used

The tolerances indicated above concern the inherent characteristics of the material and the manufacturing process and do not, in themselves, constitute defects of conformity, provided that the product complies with the essential characteristics and the applicable specifications agreed for the individual order

For personalised products, any technical tolerances must also be assessed in relation to the specific manufacturing process requested

7. Order and conclusion of the contract

Before completing the order, the customer will see an order summary containing at least the selected products, their relevant characteristics, the price, any shipping costs and the other information required by applicable law

To complete the purchase, the customer must follow the procedure provided on the website and confirm the order using the appropriate command

The customer must carefully check the information entered before submitting the order, paying particular attention to the delivery address, billing details, quantity, dimensions and any personalised characteristics

The order submitted by the customer constitutes an offer to purchase

The contract is concluded according to the procedure indicated on the website and upon subsequent confirmation of the order by Designtrasparente

Designtrasparente will send the customer an order confirmation on a durable medium containing the relevant purchase information

If an order cannot be accepted, including due to unavailability of materials, technical impossibility of manufacturing, obvious errors in the description or price, or other objective circumstances, Designtrasparente will notify the customer and, where payment has already been made, refund any amounts already paid

8. Changes requested by the customer after the order

Requests to modify a product that has already been ordered will be assessed by Designtrasparente according to the stage of processing of the order

If production has not yet started, Designtrasparente may assess the possibility of making the requested changes and may inform the customer of any change in price and production times

Once production has started, the requested changes may no longer be technically possible

Any changes requested by the customer may result in the product becoming a personalised item and, in the cases provided for by law, may exclude the right of withdrawal

9. Prices

All prices displayed on the website are expressed in Euros

Unless otherwise indicated, prices for products intended for consumers include VAT

Any additional costs, including shipping costs, are indicated to the customer before the order is concluded

The applicable price is the price displayed on the website at the time the order is submitted, except in cases of obvious errors

In the event of an obvious error in the published price, Designtrasparente reserves the right to contact the customer before shipping to verify whether they wish to proceed with the purchase at the correct price

10. Payment methods

Payment may be made using the payment methods available during the checkout process, including, where available:

  • credit or debit card
  • PayPal
  • advance bank transfer
  • any additional payment methods made available through the relevant payment service providers

PayPal may offer, where applicable and subject to PayPal's requirements and approval, payment in instalments

Through Stripe, where applicable and subject to the requirements and conditions of the relevant providers, additional payment methods may be available, including possible instalment payment solutions such as Klarna

Any instalment payment options are offered and managed directly by the respective payment service providers

The choice of instalment payment, its approval, the number and amount of instalments, any interest, costs or other conditions of the payment plan are governed exclusively by the relationship between the customer and the relevant payment service provider

Designtrasparente does not provide financing, does not determine the terms and conditions of instalment payments and is not a party to the financing relationship between the customer and the relevant service provider

The availability of individual payment methods may vary depending on the order amount, the customer's country, the product purchased, the requirements of the service provider and the conditions applicable at the time of purchase

Production and/or shipping may begin, where applicable, only after verification that payment for the order has been successfully received

In the event of non-payment or unsuccessful payment, the order cannot be processed normally

11. Production times

The production times indicated on the individual product pages refer, unless otherwise stated, to the working days required to manufacture the product and do not necessarily include transport times

For personalised or made-to-order products, production times may vary depending on the complexity of the manufacturing process and will be communicated or agreed with the customer

Any delays arising from circumstances not directly attributable to Designtrasparente will be communicated to the customer where possible

12. Shipping and delivery

Shipping is free in Italy for orders of €150.00 or more, unless different conditions or promotions are expressly indicated on the website

For orders below this amount, shipping costs are calculated during the purchasing process and communicated to the customer before the order is concluded

Delivery methods and times are those indicated during the purchasing process or in the order confirmation

Products may be shipped disassembled where this is necessary or appropriate to reduce the risk of damage during transport

Standard delivery is made to the ground floor, unless a different service has been expressly purchased or agreed

The customer is responsible for providing a correct delivery address and ensuring that the goods can be received

Any costs resulting from the recipient's absence, failure to cooperate, incorrect address information, storage or the need for a new delivery may be charged to the customer within the limits permitted by applicable law and provided that such costs have been communicated in advance

13. Inspection of goods and transport damage

The customer is invited to check the integrity of the packaging upon delivery

In the event of visible damage to the packaging, it is advisable to indicate a reservation of acceptance upon delivery and to take photographs documenting the condition of the parcel

Any damage to the goods must be reported to Designtrasparente promptly, preferably within 7 days of delivery, by sending photographs of the packaging and product to info@designtrasparente.com

The 7-day period constitutes a request for prompt notification useful for handling the claim and does not limit or exclude the consumer's rights arising from the legal guarantee of conformity, where applicable

Photographic documentation may be requested to allow Designtrasparente to verify the nature and origin of the damage and to properly handle the relevant claim

14. Consumer's right of withdrawal

For purchases made by a consumer under a distance contract, the right of withdrawal is governed by Articles 52 et seq. of the Italian Consumer Code

Unless otherwise provided by law, the consumer may exercise the right of withdrawal within 14 days from the date on which they acquire physical possession of the product

The procedures, deadlines, effects of withdrawal, return costs and relevant exclusions are described on the dedicated Right of Withdrawal page available on the website

The right of withdrawal does not apply, among other cases provided for by law, to the supply of goods made to measure or clearly personalised

Therefore, in the cases provided for by Article 59 of the Italian Consumer Code, the right of withdrawal is excluded for products manufactured according to individual specifications requested by the customer, including products for which the standard dimensions have been modified or which have been designed and manufactured specifically for the customer

The exclusion of the right of withdrawal concerns exclusively the right to reconsider the purchase and does not affect any applicable legal guarantee of conformity

15. Use and maintenance of plexiglass products

Plexiglass is a material which, by its nature, may be subject to scratches, abrasions, clouding and other surface damage in the event of friction, contact with abrasive materials, impacts, falls or incorrect cleaning

The customer is required to use and store the product appropriately according to the characteristics of the material and to follow any use and maintenance instructions provided by Designtrasparente

For cleaning plexiglass, suitable products and tools must be used. The use of abrasive materials, sponges, cloths or unsuitable detergents may cause scratches, clouding or other surface damage

Scratches, abrasions, clouding, breakage or other damage caused after delivery by improper use, handling, assembly, disassembly, cleaning or maintenance do not constitute defects of conformity attributable to Designtrasparente

The statutory legal guarantee of conformity for defects of conformity existing at the time of delivery remains unaffected, in accordance with applicable law

16. Legal guarantee of conformity for consumers

For purchases made by consumers, the statutory legal guarantee of conformity provided for by the Italian Consumer Code applies

The legal guarantee covers defects of conformity existing at the time of delivery of the goods and grants the consumer the remedies provided for by law

The legal guarantee does not constitute a guarantee against any deterioration, damage or alteration that may occur after delivery of the product

In particular, unless they result from a cause already existing at the time of delivery, the following do not constitute defects of conformity:

improper use or use that does not comply with the characteristics of the product

incorrect assembly carried out by the customer

handling or transport after delivery carried out by the customer or by third parties appointed by the customer

impacts, falls or excessive pressure

scratches, abrasions or clouding resulting from incorrect use or cleaning of plexiglass

use of abrasive or unsuitable cleaning products or tools

modifications, processing or interventions carried out by the customer or by third parties

normal deterioration resulting from use of the product

The legal guarantee may not be excluded or limited by these General Terms and Conditions where the law provides for its application

To report an alleged defect of conformity, the customer must contact Designtrasparente and provide a description of the problem, photographs and any other information useful for assessing the case

17. Guarantee for purchases made by professionals

For purchases made by professionals, companies, entities or other parties acting in the course of their professional or business activities, the provisions of the Italian Consumer Code concerning the legal guarantee applicable to consumers do not apply

Any guarantees and liabilities applicable to relationships between professionals are governed by the applicable civil law and by the conditions agreed between the parties

The professional is required to inspect the product and report any defects or non-conformities within the time limits provided for by applicable law

18. Invoicing

Customers requiring an invoice must provide the necessary information during the purchasing process or request it according to the procedures indicated on the website

The invoice is issued and transmitted in accordance with applicable tax legislation

A courtesy copy may be requested by e-mail

19. Privacy and personal data processing

The processing of the customer's personal data is carried out in accordance with the Privacy Policy published on the website

The Privacy Policy is a document separate from these General Terms and Conditions of Sale and may be consulted through the relevant link available on the website and during the purchasing process

For information concerning the use of cookies and similar technologies used on the website, the customer may consult the Cookie Policy available in the relevant section of the website

20. Communications

For communications relating to orders, purchased products, shipping, customer assistance and the exercise of rights provided for by applicable law, the customer may use the contact details indicated on the website and in communications relating to the order

Communications relating to the contract may be made by e-mail or another suitable durable medium

21. Applicable law and jurisdiction

These General Terms and Conditions of Sale are governed by Italian law

For contracts concluded with consumers, all mandatory protections provided by the Italian Consumer Code and applicable law remain unaffected, including the territorial jurisdiction of the court of the consumer's place of residence or domicile, where provided by law

For contracts concluded with professionals, companies, entities or other parties acting in the course of their professional or business activities, unless otherwise agreed in writing, the Court of Rome shall have jurisdiction over disputes arising from the contract

22. Amendments to the General Terms and Conditions

Designtrasparente may modify or update these General Terms and Conditions of Sale

Any amendments shall apply to orders placed after their publication on the website

The version of the General Terms and Conditions applicable to each order is the version accepted by the customer at the time the relevant contract is concluded.
