Right of Withdrawal
1. Consumer's right of withdrawal
Pursuant to Articles 52 et seq. of Italian Legislative Decree 206/2005 (Italian Consumer Code), consumers who purchase through the website under a distance contract have the right to withdraw from the contract without having to provide any reason within 14 days from the date on which they acquire physical possession of the product
The right of withdrawal is granted exclusively to consumers, meaning natural persons who purchase for purposes unrelated to any business, commercial, craft or professional activity they may carry out
The right of withdrawal does not apply to purchases made by professionals, companies, entities or other parties purchasing in the course of their professional or business activities
2. How to exercise the right of withdrawal
To exercise the right of withdrawal, the consumer must notify Designtrasparente of their decision to withdraw from the contract within the statutory 14-day period
The notification may be made by means of an explicit statement sent by email to info@designtrasparente.com, including at least:
order number
first and last name of the purchaser
product or products for which the right of withdrawal is being exercised
express statement of the intention to withdraw from the contract
The consumer may use their own explicit statement or, where available on the website, the specific withdrawal form
Once the notification has been received, Designtrasparente will provide the necessary instructions for returning the product
3. Return of the product
The product must be returned without undue delay and in any event within 14 days from the date on which the consumer communicated their decision to withdraw
The return must be made in accordance with the instructions provided by Designtrasparente
The consumer is responsible for properly preparing the product for shipment and must take all necessary precautions to ensure that the product is not damaged during return transport
The use of the original packaging and all originally supplied protective materials is strongly recommended where these are still available
If the original packaging is no longer available, the consumer must use suitable packaging capable of providing adequate protection for the product during transport
The direct costs of returning the product shall be borne by the consumer, unless otherwise indicated by Designtrasparente or otherwise required by law
4. Condition of the returned product
The consumer may handle the product to the extent necessary to establish its nature, characteristics and functioning
If the product is used or handled beyond what is necessary for such verification and this results in a decrease in the value of the product, the consumer may be liable for the corresponding decrease in value within the limits provided by applicable law
For plexiglass products, given the particular delicacy of the material, the consumer must pay particular attention when handling, assembling, disassembling and packaging the product
Scratches, abrasions, breakage, clouding or other damage caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the product may result in a decrease in the value of the product and the corresponding liability of the consumer within the limits provided by law
The mere opening of the packaging or inspection of the product does not in itself result in the loss of the right of withdrawal
5. Refund
In the event of a valid exercise of the right of withdrawal, Designtrasparente will refund the payments received from the consumer without undue delay and in any event within 14 days from the date on which Designtrasparente was informed of the consumer's decision to withdraw from the contract
The direct costs of returning the product shall be borne by the consumer, unless otherwise indicated by Designtrasparente or otherwise required by law
The refund will be made using the same payment method used by the consumer for the initial transaction, unless otherwise expressly agreed with the consumer and provided that such refund does not incur any costs for the consumer
The product must be returned intact and unused, except for handling strictly necessary to establish its nature, characteristics and functioning. If the product is returned damaged, altered, used or otherwise with a decrease in value attributable to the consumer, Designtrasparente reserves the right to apply a reduction to the refund proportionate to the decrease in value of the product, up to and including the possibility of no refund where the product has no commercial value
6. Exclusions from the right of withdrawal
The right of withdrawal does not apply in the cases expressly provided for by Article 59 of the Italian Consumer Code
In particular, in the cases provided for by law, the right of withdrawal is excluded for goods made to the consumer's specifications or clearly personalised on the basis of the customer's specific requests
The following products are included among those for which the right of withdrawal is excluded, in the cases provided for by law:
products made with dimensions different from the standard dimensions indicated in the relevant product page, following a request from the customer, including modifications to width, depth, height or other dimensions
products for which shapes, configurations, processing or characteristics different from the standard configuration have been requested
products designed or manufactured specifically on the basis of indications, drawings, measurements or specifications provided by the customer
products not included in the catalogue and manufactured specifically for the customer
products manufactured on the basis of a specific request entered by the customer in the order notes
In particular, a request by the customer to modify the standard dimensions of a product through the order notes involves the manufacture of the product according to customised specifications and, in the cases provided for by law, excludes the right of withdrawal
Where a product not included in the catalogue is manufactured specifically for a customer, Designtrasparente may create a dedicated product page containing the characteristics and conditions agreed with the customer
In this case as well, in the cases provided for by Article 59 of the Italian Consumer Code, the product is considered to have been manufactured according to the customer's specifications and the right of withdrawal is excluded
The exclusion of the right of withdrawal applies exclusively to the right to change one's mind and does not affect the consumer's rights relating to the legal guarantee of conformity
7. Damaged or defective products
The right of withdrawal must be distinguished from the legal guarantee of conformity
If the product has a lack of conformity that existed at the time of delivery, the consumer retains all rights provided for by the legal guarantee of conformity, regardless of the right of withdrawal
In the event of damage apparently occurring during transport, the customer is advised to promptly document the condition of the packaging and the product by means of photographs and notify Designtrasparente at info@designtrasparente.com
The notification may include:
order number
photographs of the external packaging
photographs of the product
description of the problem
any documentation relating to delivery or transport
Prompt notification of the damage enables Designtrasparente to verify more quickly the nature and origin of the problem and to manage the relevant case
Failure to immediately notify the carrier or the absence of a delivery reservation does not in itself result in the loss of rights arising from the legal guarantee of conformity where such rights are applicable
For lack of conformity, the provisions relating to the legal guarantee of conformity set out in the General Terms and Conditions of Sale shall apply
8. Personalised products and the right of withdrawal
Before purchasing a personalised product, the customer must carefully check the requested characteristics, measurements and specifications
Once the order has been confirmed, requests for personalisation may result in the exclusion of the right of withdrawal in the cases provided for by Article 59 of the Italian Consumer Code
In particular, a request to modify the standard dimensions entered in the order notes before payment constitutes a specific request by the customer and, in the cases provided for by law, results in the exclusion of the right of withdrawal
Likewise, products manufactured specifically for the customer through a dedicated product page are subject to the same conditions
The exclusion of the right of withdrawal does not limit the legal guarantee of conformity applicable to the product
